This helps EUWCD protect your well by keeping records of its location and ensuring compliance with spacing requirements to prevent other wells from interfering with yours. It also helps EUWCD protect against waste and contamination by ensuring wells are constructed properly and meet state and local requirements.

Not necessarily. An exempt well is determined by the amount of water it can produce per minute. This is called gallons per minute (GPM). Exempt wells are those that produce less than 17.5 GPM or less than 25,000 gallons per day. Additional rules for exemption wells are those used solely for drilling rig supply in oil and gas exploration or used for mining activities under a Texas Railroad Commission permit.

Notice to Purchaser

This form is used to notify a buyer that the property they are purchasing is within EUWCD and explains the buyer’s responsibility to register or transfer ownership of any existing wells on the property within 45 days of the sale.

Exempt Wells

If you own or plan to drill a small-capacity well for domestic, livestock, or other exempt uses, you are required to register it with the Evergreen Underground Water Conservation District (EUWCD). Exempt wells are those producing less than 25,000 gallons per day or less than 17.5 gallons per minute (GPM). While these wells do not require a permit, registration is required to help the District monitor groundwater use, protect well owners, and ensure compliance with well-spacing regulations.

Registering your exempt well is a simple process and provides important benefits, including documentation of your well and spacing from neighboring wells. If your well is altered to exceed the GPM limits or used for a non-exempt purpose, a permit may be required. Contact the District office by calling 830-569-4186 or email us here.
